Terms of Service

Terms governing KeyTern apartment information, referrals, Exclusives, rebates, and optional services.

Effective Date: October 13, 2026

These Terms of Service ("Terms") govern your use of https://www.keytern.com and the apartment-search, apartment-deal, rebate, local-intelligence, and move-in services offered under the KeyTern brand. By using the website or submitting a request, you agree to these Terms.

1. About KeyTern

KeyTern is a consumer-facing apartment-search, savings, rebate, and move-in-services brand. KeyTern is not a landlord, apartment owner, property manager, leasing office, lender, insurer, or governmental agency.

Activities that constitute real estate brokerage services are performed only through appropriately licensed Florida real estate professionals and the applicable registered real estate brokerage, currently US Realty Hub. The brand name itself does not create a separate real estate brokerage.

2. Apartment-Locating Service

Our apartment-locating service helps users search for apartment communities, compare information, review publicly available or property-provided details, request assistance, and identify potential deals or incentives.

Under our current business model, renters are not charged a fee by KeyTern for ordinary apartment-locating services. Participating apartment communities or property-management companies may compensate the licensed brokerage for a qualifying referral. If we ever offer a renter-paid service, any fee and applicable terms will be disclosed separately before you agree to that service.

3. Real Estate Brokerage Relationships

Using the website, requesting apartment information, or the fact that an apartment community may pay compensation does not, by itself, establish a particular agency or brokerage relationship. Any brokerage relationship is determined by applicable Florida law and any separate disclosure or agreement that applies to the transaction.

KeyTern does not represent an apartment community merely because the community appears on the website, and a community does not endorse KeyTern merely because we display publicly available information about it or may be eligible to receive referral compensation.

4. Apartment Information, Availability, Pricing, and Specials

Apartment information can change rapidly. Rent, availability, floor plans, deposits, application fees, administrative fees, pet charges, parking charges, utility charges, required monthly fees, lease terms, income requirements, concessions, and other property terms are controlled by the apartment community or property manager.

We may obtain information from apartment communities, management companies, public sources, official websites, public records, third-party services, user reports, or other sources we reasonably believe to be useful. We work to keep information accurate, but we do not guarantee that every listing, price, special, fee, rating, map location, travel time, amenity, or policy is complete, current, or error-free.

You should confirm all material terms directly with the apartment community before applying, paying money, signing a lease, or making a relocation decision. The lease and any written concession addendum issued by the property control your tenancy.

5. Effective Rent and Savings Estimates

Any "effective rent," "estimated savings," concession value, or similar calculation shown on the website is an informational estimate based on stated assumptions. It is not a rent quote, lease offer, guarantee, appraisal, or promise that a property will apply a concession in a particular way.

Actual economic value depends on the selected apartment, base rent, lease length, move-in date, concession structure, mandatory fees, eligibility rules, and the property's final lease documents. Unless expressly stated otherwise, estimated effective rent does not include every fee, utility, tax, insurance charge, pet charge, parking charge, or optional service.

6. Rebate and Moving-Incentive Program

Some qualifying renters may be eligible for a rebate or moving incentive of up to the amount advertised on the applicable offer, currently up to $250 for certain participating apartment referrals. A displayed rebate is an eligibility opportunity, not an unconditional promise of payment.

Unless a specific written offer states otherwise, rebate eligibility generally requires all of the following:

  • the apartment community participates in a referral or locator compensation program applicable to the transaction;
  • you use KeyTern before leasing and follow the property's required referral-credit procedure;
  • the community accepts and records the referral under the licensed brokerage or other authorized referral source designated by KeyTern;
  • you sign a qualifying lease and satisfy the property's requirements;
  • you complete the required move-in or other qualifying event;
  • the transaction is not excluded by the community's referral rules, including because of prior registration, a prior tour, prior contact, a prior application, renewal, transfer, corporate housing arrangement, duplicate lead, or another referral source;
  • the licensed brokerage actually receives and clears the applicable referral commission or compensation; and
  • payment of the rebate is lawful and permitted by the supervising brokerage and applicable property program.

A rebate may be reduced, delayed, or unavailable if the apartment community changes its program, rejects referral credit, disputes the referral, does not pay compensation, pays less compensation than expected, the lease is canceled or does not qualify, or another eligibility condition is not satisfied.

Rebate amounts may vary by property or transaction. Property concessions and KeyTern rebates are separate unless expressly stated otherwise. Apartment communities control their own rent specials, and those specials may change or end without notice.

When a rebate is earned, payment will be processed after the required commission or referral compensation has been received and cleared and after any reasonable verification is completed. We may request information reasonably needed to verify identity, eligibility, payment status, or compliance with legal and brokerage requirements.

7. No Guarantee of Approval or Housing

Apartment communities establish and apply their own screening, income, credit, rental-history, criminal-history, occupancy, pet, identification, and other lawful qualification standards. KeyTern does not control property approval decisions and does not guarantee that you will qualify for, be approved for, or be offered any apartment.

8. Fair Housing

KeyTern supports equal housing opportunity and provides housing-related services without unlawful discrimination. We do not agree to steer users toward or away from housing because of race, color, religion, sex, national origin, familial status, disability, or any other characteristic protected by applicable law.

Search filters and recommendations may use lawful, non-protected criteria such as rent range, location, commute, apartment size, amenities, availability, pet policies, or other objective preferences.

9. Maps, Distances, Reviews, and Local Information

Maps, commute estimates, distances, neighborhood descriptions, ratings, reviews, nearby destinations, school or employer references, and similar information are provided for general informational purposes. Travel times vary by route, traffic, time of day, weather, construction, and other factors.

Third-party ratings and reviews belong to their respective sources and may change. References to employers, attractions, neighborhoods, schools, brands, or landmarks do not imply affiliation or endorsement.

10. Public Records and Local-Intelligence Features

We may offer features that summarize permits, planning activity, development proposals, public records, construction activity, or other local information. These features are informational tools, not title reports, zoning opinions, engineering reports, environmental reports, legal opinions, or guarantees that a proposed project will be approved, built, delayed, changed, or canceled.

Public records and government datasets can be incomplete, delayed, corrected, or interpreted differently by the responsible agency. Users should consult the official agency or an appropriate professional before relying on this information for a legal, financial, investment, or property decision.

11. Move-In and Other Services

We may help users request cleaning, movers, moving labor, junk removal, internet, utilities, insurance, or other services. A service may be provided by KeyTern, an affiliated brand, or an independent third-party provider. The applicable booking, quote, confirmation, or service agreement should identify the provider and the terms that apply.

Independent providers control their own pricing, scheduling, employees or contractors, licensing, insurance, service quality, warranties, and performance. Unless expressly stated otherwise, KeyTern is not responsible for the acts or omissions of an independent provider.

We may receive referral, affiliate, marketing, or service compensation from certain providers. Such compensation does not change the price or terms offered by a provider unless specifically disclosed.

12. Communications

When you submit a form or request assistance, you authorize us to contact you regarding that request using the contact information you provide. This may include email, telephone, or text messages reasonably related to your inquiry, referral, rebate, or requested service.

Marketing communications are subject to applicable consent and opt-out requirements. Where separate prior consent is legally required for automated or marketing calls or texts, it will be requested separately. Acceptance of these Terms alone is not intended to constitute such separate consent.

13. User Responsibilities

You agree to provide information that is accurate to the best of your knowledge and not to impersonate another person, submit fraudulent claims, manipulate referral records, interfere with website operation, attempt unauthorized access, or use the website for unlawful purposes.

You may not systematically scrape, copy, harvest, reproduce, resell, or commercially exploit the website, its apartment database, deal calculations, proprietary interfaces, or other protected content except with our written permission or as otherwise permitted by law.

14. Intellectual Property

The KeyTern website, branding, original text, software, interface designs, graphics, databases, calculations, and other original content are owned by or licensed to us and are protected by applicable intellectual-property laws. Third-party names, marks, photographs, reviews, and other materials remain the property of their respective owners.

15. Third-Party Links and Platforms

The website may link to apartment websites, application portals, maps, review services, vendors, social networks, payment systems, or other third-party platforms. We do not control independent third-party websites and are not responsible for their content, security, availability, privacy practices, or terms.

16. No Legal, Tax, Financial, or Professional Advice

Website content is general information. Unless expressly stated in a separate engagement, KeyTern does not provide legal, tax, accounting, lending, insurance, engineering, environmental, or investment advice. You should consult an appropriate professional for advice specific to your circumstances.

17. Disclaimer of Warranties

To the fullest extent permitted by law, the website and informational tools are provided on an "as is" and "as available" basis. We do not warrant uninterrupted availability, error-free operation, or the accuracy, completeness, or continued availability of information supplied by apartment communities, public agencies, vendors, or other third parties.

Nothing in these Terms excludes warranties, duties, or rights that cannot lawfully be excluded.

18. Limitation of Liability

To the fullest extent permitted by law, KeyTern, its owners, affiliates, licensed real estate professionals, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the website or reliance on third-party apartment, public-record, vendor, map, pricing, or promotional information.

Nothing in these Terms limits liability to the extent such limitation is prohibited by applicable law.

19. Indemnification for Misuse

To the extent permitted by law, you agree to be responsible for losses, claims, or expenses arising from your unlawful misuse of the website, fraud, intentional interference with the service, infringement of third-party rights, or material violation of these Terms.

20. Privacy

Our collection and use of personal information is described in the KeyTern Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.

21. Changes to Services and Terms

We may change website features, eligibility rules for future offers, service availability, or these Terms as the business evolves. Changes will apply prospectively unless a change is required by law or the applicable offer expressly provides otherwise. A rebate eligibility determination already confirmed in writing will remain subject to the terms of that confirmation and applicable law.

22. Governing Law

These Terms are governed by the laws of the State of Florida, except to the extent federal law controls or applicable law requires otherwise. Any legal proceeding must be brought in a court with lawful jurisdiction and venue.

23. Severability and No Waiver

If a provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law. Failure to enforce a provision on one occasion does not waive the right to enforce it later.

24. Contact

Questions about these Terms may be sent to support@KeyTern.com.

25. KeyTern Exclusives and Property-Specific Offers

KeyTern Exclusives are separately identified offers for particular apartment communities. They may provide an additional renter rebate under stated conditions. An Exclusive is distinct from a property-sponsored rent concession unless the offer says otherwise, and does not imply that KeyTern exclusively represents, manages, or is endorsed by the property. Property, referral method, qualification requirements, stated reward, offer period, and any written restrictions control. Standard offers may advertise up to $250; a separately labeled Exclusive may state a different amount where lawful and approved by the supervising brokerage.

Renter incentives are conditional rather than guaranteed. An apartment community may decline referral credit for an earlier contact, tour, existing lead, duplicate, prior application, or its own referral policies. Verify referral requirements before applying or leasing independently if you want us to pursue a qualifying referral.

26. Referral Submission and Staff Acknowledgments

Apartment communities may accept email referrals, guest cards, approved portals, or other property-specific procedures. KeyTern may transmit information you authorize as reasonably necessary to register a lead. Email delivery, a dashboard entry, a property's acknowledgment, a recipient-reported status, or a referral confirmation message does not establish accepted registration or a right to a rebate. Property confirmation, applicable program rules, brokerage approval, and commission records govern.

Only appropriately licensed professionals through the supervising brokerage provide activities requiring a real estate license. Nonlicensed staff may assist only with permitted administrative work.

27. Affiliate Links and Retailer Transactions

Some products, shopping links, or move-in recommendations may generate affiliate or advertising compensation for KeyTern. Product orders, pricing, fulfillment, quality, and returns are governed by the retailer, not KeyTern. Material relationships will be disclosed in accordance with applicable requirements.

28. Browsing Does Not Create Brokerage Representation

Viewing apartment data, browsing the site, or saving a listing alone does not create an agency relationship, guarantee property availability, or guarantee a referral commission or rebate. Any brokerage relationship and legally required disclosures are handled by the appropriately licensed real estate professional and their brokerage, US Realty Hub. KeyTern is a consumer-facing brand, not a separately licensed real estate brokerage.
